Recruitment Leads / Legal / Leads terms of service
Leads terms of service
For business customers who subscribe to lead emails, the customer portal or exports.
1. The service
Home Improvement Leads are scored summaries of council planning applications for trades such as builders, kitchen fitters, window installers and solar installers. Recruitment Leads are lists of care providers that are new or show signs of expansion, for recruitment businesses. Leads are indications taken from public registers. We do not promise that any lead will become work, that a provider is hiring, or that data is complete or current. Project values are rough guides, not quotes.
2. Who can buy
The service is for businesses and people buying for their business. [If you accept consumers, add the statutory 14-day cancellation right for distance contracts and review the new subscription rules.]
3. Plans, price and payment
Plans and prices are shown at the time you subscribe. Payment is taken by Stripe. Subscriptions renew each [month] until cancelled. You can cancel at any time from the Stripe customer portal linked from your account page; access then continues to the end of the paid period. [State refund and trial rules.] Prices are exclusive of VAT.
4. Licence and restrictions
We give you a non-exclusive, non-transferable licence to use the leads for your own business. You must not resell, share, publish or pass leads to others, or use them to build a competing product. Accounts are for the named users on your plan.
5. Your legal duties when you use the leads
- You are responsible for contacting people lawfully: UK GDPR, the Data Protection Act 2018 and PECR.
- Do not email or text individuals, sole traders or ordinary partnerships for marketing without their consent. Limited companies may be emailed at corporate addresses if you identify yourself and give a free opt-out.
- Screen telephone numbers against the TPS and CTPS before marketing calls.
- Planning leads are about people's homes. Be considerate: introduce yourself, say where you found the project, and stop if asked.
- If you are a recruitment business, you must follow the Conduct of Employment Agencies and Employment Businesses Regulations 2003 and any rules for the sector you serve.
- Honour opt-out requests and tell us if someone asks not to be contacted so we can suppress them.
6. Data protection roles
We and you are each independent controllers of the lead data for our own purposes. Our privacy notice and business contacts notice explain what we do.
7. Availability and changes
Sources can change or stop. We may change the service and will give reasonable notice of material changes. [State what happens if a source is lost.]
8. Liability
Nothing excludes liability that cannot be excluded by law. Otherwise, our total liability in any 12 months is limited to the fees you paid in that period, and we are not liable for lost profit or lost business. [Solicitor to confirm.]
9. Suspension and ending
We may suspend or end access if you breach these terms or the law. You may end your subscription at any time.
10. Law
Laws of England and Wales apply; the courts of England and Wales have jurisdiction.
